Terms and Conditions Agreement for Top Barz Inc.
1. Introduction
Welcome to Top Barz Inc. (“Company”, “we”, “our”, “us”). By accessing or using our music recording services (“Service”), you ("User", "you", or "your") agree to be bound by the following terms and conditions ("Terms"). Please read these terms carefully before using our services. These Terms govern your use of the Service available through our website.
2. Collection of Information
During the sign-up process, we collect personal information, including your name, contact details, city, date of birth, and preferences related to our Service. This collection is crucial for providing and enhancing our services and for communication purposes.
3. Use of Information
We utilize the information collected to:

Communicate with you regarding your bookings and special offers, keeping you informed and engaged with our latest opportunities.
Enhance your overall experience by tailoring our services to your preferences, ensuring that your time at Top Barz Inc. is as enjoyable and satisfying as possible.
Verify the identity of the party visiting the studio, ensuring security and a seamless service experience.
Target our customers with promotions exclusively from Top Barz Inc., such as birthday promotions, aiming to provide you with special offers that celebrate your moments.
4. Data Retention
Your personal information is retained only as long as necessary for the purposes outlined in these Terms. Notably, we do not store payment information, reflecting our commitment to your privacy and security.
5. Release for Marketing
By participating and/or using the Service, you hereby grant Top Bars Inc. the right, but not the obligation, to use photos and videos captured during your session in our marketing materials. This may include but is not limited to, use in promotional videos, social media posts, and advertising campaigns.
6. Liability for Damages
Should equipment or furniture be damaged during your session, due to actions attributed to you, your guests, or your party, you may be held liable for a portion of the repair costs. This encompasses damages to headphones, sound systems, speakers, and other studio equipment and property.
7. Safety Measures
As a guest, you are not expected nor allowed to operate or interact with mixing and engineering equipment. Only authorized personnel are permitted to handle such equipment. Your primary focus should be on the recording experience within the booth, adhering to all safety guidelines while navigating the studio premises. Your failure to adhere to any safety guidelines within this agreement or provided by the engineer or session manager, may result in the early termination of your session (“Session”) and forfeiture of all monies paid for the Service.
8. Music Rights Compliance
You bear the responsibility for any recordings and music produced during the Session, including ensuring compliance with applicable music rights and industry laws. We advise you to consult with an entertainment attorney to be advised of your rights and responsibilities related to the publication or commercial use of any materials recorded during a session. Top Barz, Inc. shall not be responsible for any usage of the materials created from the Session. All clearance and administrative responsibilities related to the materials shall be your sole responsibility.
9. Accommodations for Disabilities
We are committed to inclusivity and accessibility. Should you have any impairments or special needs, kindly inform us in your booking notes. We will make all necessary accommodations to facilitate your session.
10. Conflict Resolution
In the event of disputes or conflicts, please reach out to us at support@topbarz.xyz for resolution.
11. Refund Policy
Deposits for bookings are non-refundable. If you have paid your Session fee (“Fee”) in full and you cancel your Session more than 48 hours from your original Session date, you shall be entitled to refund of your Fee less the deposit.
12. Rescheduling and Cancellation Policy
In the event that the Fee has been paid in full and you need to reschedule, we offer the option to rebook your Session to another available date, provided the request is made no less than 48 hours before the scheduled Session. In the event of rescheduling within such window, you understand that the Fee minus the deposit shall be applied to your rescheduled date and you will be responsible to pay the difference. Dates not rebooked within three (3) months of the original booking date shall result in a forfeiture of the Fee.
13. Session Management and Conduct
The session manager/engineer has the authority to terminate your Session if participants exhibit belligerent, aggressive, or inappropriate behavior or violate our rules of conduct. These rules include respecting the studio space and equipment, the session engineer, fellow participants, and understanding that no refunds will be issued if asked to leave due to policy violations. You understand that your Session will begin promptly at the start time booked and will end promptly at the end time stated. In the event that you are late for your Session start time, no additional time will be added to your Session. Please note that the last thirty (30) minutes of each session shall be used for studio clean-up, your Session files downloads, and Session termination administration. In the event that you, your guests and/or party fail to exit the studio and/or premises at the conclusion of your Session, your card on file shall be charged a rate of $50 for every ten minutes (10) your Session runs beyond your Session end time. In the event of damages caused by your and/or your guests during the Session to the studio, studio equipment or premises, you authorize Top Barz, Inc. to charge your card on file for such damages, not to exceed $1,000.00.
14. Limitation of Liability
Our liability in connection with any services provided is strictly limited to the amount paid for such services.
15. Governing Law
These Terms shall be governed and construed in accordance with the laws of the state of Georgia, United States, without regard to its conflict of law provisions.
16. Changes to Terms and Conditions
We reserve the right to modify these Terms at any time. Any changes will be notified to you by posting the updated Terms on our website.
